History

Foley was mentioned as the landlord of the Carriers' Arms in a fraud case in February 1861.[1] Foley was listed as the publican at the Dowling Forest Hotel in June 1861.[2] He was a witness in a case involving two men who had assaulted and robbed a man after leaving the hotel.[2]In May 1862 he would not press charges against a man who had stolen 5s from the Dowling Forest Hotel.[3] In June 1862 he was the publican at the Commercial Hotel at Dowling Forest.[4]

Foley was the publican at the Plough and Harrow Hotel in Market Square from at least 1863-1867. His name appears in the Licensing Court records.[5]

In 1864, Foley was given a temporary license to sell alcohol at the Ballarat Agricultural Society Show.[6]

In December 1864 Foley was threatened at the hotel:

"THREATENING TO STAB.-Michael Curtain was charged with having, on the 28th instant, attempted to stab, with a butcher's knife, Timothy Foley, publican, Market Square. The prosecutor deposed that the prisoner came into his bar in the afternoon, and had a glass of colonial wine. He had a magpie with him, and. seemed to be "suffering from the horrors of drink." He then went out; and after wards returned and accused witness of stealing his magpie. He also threatened to put the knife through him. Witness did not wish to press the charge, as be believed the man was then out of his senses with drink. Constable Nolan deposed that when he was called to the place he found the prisoner very violent from drink, hut that he had since recovered, and now was full of regrets for what had happened. The accused said he got too much drink at the fete on Monday, and had not been quite right ever since. Constable Nolan said there would be half-a-crown for the cab in which the accused had been brought to the lock-up. Sentenced to forty-eight hours imprisonment, which the Police Magistrate said would probably be serviceable to the accused."[7]
